Legal Note

The word বিনা ওসিয়তে is critical where intestate succession is the basis for Farayez or other succession-law application. The recital should not skip middle deaths or via-links. If the chain of devolution was complex in the audit file, the recital must carry that complexity honestly in compressed but clear narrative form.

Where record discrepancy exists—such as area mismatch or dag transformation—the Bengali recital model should also allow insertion of a normalization clause. This prevents the final deed from pretending that all land-description sources said the same thing when they did not.

The English preamble should identify the deed with professional precision and list the parties in full legal identity form. Where some parties act through attorney, guardian, or branch-based representation, the role should be made express at the preamble stage rather than hidden later in the body.

For foreign heirs, passport details, overseas address, and attorney-reference details may need to be added depending on the execution structure. The English model should never omit identity precision just because the audience is international.

14.2.2 The “Whereas” Sequence

The English recital structure should mirror the verified legal chain: original title source, death or transfer sequence, present co-ownership position, need for partition, and final agreement to partition. The language should remain concise but legally exact.

The English recital model should be customized carefully for intestate or testate devolution. Do not use a “lawful heirs” recital mechanically if the file actually depends in part on a will, a release deed, or an earlier judicial decree.

14.2.3 The Covenant of Mutual Release

The English deed model must also carry the mutual-release logic in strong operative language. This is especially important in English because looser commercial phrasing may sometimes hide the partition-specific quitclaim function if the drafter is not careful.
